The attempt by Okey Ogbodo to scuttle the APC leadership in Enugu State suffered a fatal blow today as the Federal High court sitting in Enugu reiterated that the leadership of APC under Barr Ben Nwoye is the only one known to law.
The Enugu Federal High Court refused the prayers of Deacon Okey Ogbodo through his his counsel Barr. Menkiti to nullify the State congress of APC conducted by the state chairman of the party Ben Nwoye.
Counsel to Nwoye Barr. Ugo Ukwueze argued that Ben Nwoye got a waiver from the party through the general waiver granted to all incumbent chairmen of the party seeking reelection by the party National Executive Council.
Justice Liman ruled that though Barr Ben Nwoye wasn’t issued a personal waiver to re-contest, the certificate of return issued to the state Chairman Barr. Ben Nwoye can’t be retrieved on that premise because the issuing of waiver is entirely a party affair.
In conclusion Ben Nwoye remains the chairman of Enugu State APC.
