A Federal High Court in Abuja on Monday, has stopped President Muhammadu Buhari, Attorney General of the Federation, and the Senate President from tampering with the newly amended Electoral Act 2022.
Ruling on an ex parte application filed by the Peoples Democratic Party (PDP), Justice Inyang Ekwo ordered that the electoral act should not be tampared with without due process.
Justice Ekwo stressed that the act is now a valid law and as such, its validity should be challenged in a competent court of jurisdiction.
The Peoples Democratic Party, PDP, has in a suit marked FHC/ABJ/CS/247/2022 sued President Buhari, Senate President Lawan, AGF Malami and Speaker of the House, Gbajabiamila in what it described as ‘a bid to tinker with the newly amended Electoral Act’.
Others joined in the suit are the clerk of National Assembly, Senate leader, house leader, and Independent National Electoral Commission (INEC).
Chief James Ogwu Onoja SAN, counsel to PDP had asked the court to restrain all the defendants in the suit from removing section 84 (12) of the Electoral Act or preventing It from being implemented for the purpose of the 2023 general elections.
