A Court of Appeal has on Tuesday, quashed all 15 charges by the Economic and Financial Crimes Commission, EFCC, leveled against former Governor Gbenga Daniel of Ogun.
The judge, Justice Yargata Nimpar, while reading the judgment, said he found merit eight issues brought before him by the ex-Ogun governor against the anti-graft agency.
The judge stressed that the former governor, was in the past tried in Abuja for a crime he ‘purportedly’ committed against Ogun State, stressing that the court lacked jurisdiction to try him.
The judge also described the prosecution as malicious and also advised the commission not to use state fiat to Prosecute a governor for act protected by a federal legislation.
The former Ogun governor was attained on a 43-count charge for allegedly stealing and mismanaging over N7 billion as Ogun governor.
Mr Daniel was arraigned on October 12, 2011, but the court dismissed the case of the commission’s failure to obtain a leave of court to ammend information it had presented.
He was later re-arraigned on April 16, 2012, for mismanaging N211.3 million
