Godswill Akpabio
Ex Minister of Niger Delta Affairs Senator Godswill Akpabio

A Federal High Court sitting in Abuja has dismissed the suit filed by Udom Ekpoudom challenging the All Progressives Congress, APC’s, failure to submit his name to Independent National Electoral Commission (INEC) as the party’s candidate for the Akwa Ibom North West Senatorial District for the 2023 general elections.

Delivering judgment on Friday, Justice Donatus Okorowo, held that the plaintiff’s action wasn’t justiciable, hence, the suit was incompetent.

Okorowo revealed that the matter bordered on the internal affairs of a party.

He, however, held that the court lacked jurisdiction to entertain the suit.

NAN reports that Ekpoudom was the plaintiff in the case.

Ekpoudom had sued the APC and Sen. Godswill Akpabio as 1st and 2nd defendants in the suit.

The lawsuit followed the emergence of Akpabio, a former Minister of Niger Delta Affairs, as the APC’s candidate in the APC rerun primary poll held a few months ago.

The state’s APC Chairman, Stephen Ntukekpo, had disclosed that he was instructed by the party at the national level to conduct a rerun over alleged infractions in which Akapbio had emerged winner with 478votes while Ekpoudom pulled three votes.
