The election petition tribunal sitting in Enugu, has nullified the victory of labour party candidate Hon. Bright Ngene as the House of assembly member representing Enugu South urban constituency.

The three-man panel led by A. M. Abubakar ordered a rerun election in Enugu south urban constituency.

The lead judge who delivered the Judgement emphatically stated that the judgement of the tribunal was on the grounds that the number of votes credited to the said winner of the elections were less than the number of disenfranchised voters in the constituency.

The lead judge in his delivery of justice stated that inec was wrong to have declared Bright Ngene winner of the election and that inec erred by not declaring a re-run election before declaring a candidate winner of the elections.

The judge ruled that a re-run election be conducted in the constituency.

The lead judge further stated that the re-run election be conducted within ninety days (90) of the delivery of this judgement given today the 13th September 2023.

Hon Sam Ngene,a one-term state lawmaker, had challenged the declaration of Hon. Bright Ngene by the Independent National Electoral Commission (INEC) as the winner of the election on the grounds that the number of cancelled votes were more than the number of votes credited to the first respondent Hon. Bright Ngene.
