The court of Appeal sitting in Lagos has set aside the ruling of the Tribunal and affirmed the election of the member representing Ideato North and South Federal Constituency, Ikenga Imo Ugochinyere as the validly elected member of the House of Representatives.
Journalist101 reported that the election Tribunal sitting in Mararaba High Court ruled that Ugochinyere’s PDP had no candidate for the election as Primaries didn’t hold in the Federal Constituency.
The panel which delivered the judgement on September 10th, also directed the Independent National Electoral Commission, INEC, to conduct rerun election Calls in 4 Wards between APC and LP candidates.
In a unanimous judgment delivered on Wednesday, the panel headed by Justice Abubakar Babandi Gumel overruled the judgments of the Tribunal, stating that the petition was a preelection matter and as such, Tribunals do not have jurisdiction over pre-election matters.
