A victim of police brutality, Mr. Micheal Amaechi Aneke has dragged the Attorney-General of the Federation, Chief Lateef Olasunkanmi Fagbemi, SAN before an Abuja Federal High court for contempt.

Barr. Anayo Ilo, the counsel to Mr. Aneke in a motion on notice for committal of the AGF said Mr. Fagbemi “wilfully refused to grant consent to enforce money judgment handed down by this Honourable Court on 29 August, 2022 in Suit No. FHC/ABJ/CS/1240.2020, in favour of the Applicant and against the Inspector-General of Police (IGP), despite several letters and requests by the applicant to the Respondent for consent to enforce the said judgment.”

Ilo said the Attorney-General of the Federation also failed to obey the order of mandamus compelling him to grant his client consent to enforce the judgment of 29 August, 2022, a well as another order made by the court on the 3rd day of July, 2023 mandating him (the AGF) “to forthwith, grant the applicant the consent to enforce the judgment of the Court delivered on 29 August, 2022 in Suit No. FHC/ABJ/CS/1240/2020.”

In the motion entered on November 27th, 2023 with SUIT No: FHC/ABJ/CS/646/2023 the plaintiff is seeking among others:

“AN ORDER of this Honourable Court directing the Respondent to purge himself of his deliberate, wilful, persisting and contemptuous disobedience of the order of this Honourable Court made on the 3rd day of July, 2023 compelling you to forthwith, grant the Applicant consent to enforce the Judgment of the Federal High Court, Abuja Division delivered on the 29th day of August, 2022 in Sult No. FHC/ABJ/CS/1240/2020.

“AN ORDER summoning Chief LATEEF OLASUNKANMI FAGBEMI, SAN who is currently occupying the office of the Respondent, to appear personally before this Honourable Court for the purpose of enforcement of an order of committal upon him.

“AN ORDER of this Honourable Court committing the Respondent personally to prison for a term of 3 months or such other period as the Honourable Court may otherwise determine for reason of the contempt committed in connection with these proceedings before this Honourable Court, until the Respondent is purged of his contempt as directed by the Court.

“AND FOR SUCH FURTHER consequential or ancillary orders as may be required to enforce the Court’s committal proceedings and order.
