An Abuja division of the court of appeal have on Thursday nullified the election that brought Mr. Ned Nwoko as the winner of the Delta North Senatorial district will election.
The court ruled that the decision of the federal high Court which recognized Mr. Nwoko as the winner of the election by INEC was wrongly filed.
“As at the time the matter was instituted at the Federal High Court, the case was statute barred. We set aside the decision of the Federal High Court and strike out the case,” the court decided.
With the decision of the court, Mr. Nwoboshi Peter who was also a contender under the platform of the PDP during the party’s primaries will now be recognized as the Senator elect for the district.
It will be recalled that INEC had withdrawn the certificate of return issued to Mr. Nwoboshi following a ruling by the Federal High Court.
