The Director of political matters, South-East Presidential Support Committee, Hon. Maxwell Samuel Okoye, has approached a Federal High Court in Awka, challenging the nomination of Senator Andy Uba as the candidate of the All Progressives Congress, APC, for the November 6 governorship election in Anambra state.

Okoye, alongside 13 other gubernatorial aspirants, participated in the June 26 primary election conducted by the Chairman of the APC primary election panel and Governor of Ogun State, Prince Dapo Abiodun, at Golden Tulip Hotel, Agulu Lake.

In a motion filed on July 9, the aggrieved aspirant, in Suit No FHC/AWK/CS/48/2021, asked the court to declare him winner of the June 26 governorship primary and to direct the Independent National Electoral Commission, INEC, to recognize and publish his name as the duly nominated flag bearer of the party.

The APC chieftain sought the relief of the court to order an interim injunction restraining the APC and INEC from forwarding and publishing Uba’s name as the candidate of the party pending the determination of the suit.

Okoye also prayed the court to, in the interim, restrain Senator Uba from parading himself as the candidate of the APC pending the determination of the motion on notice.

In its ruling, the court, in view of the provisions of Section 87(10) of the Electoral Act, 2010, ordered parties joined in the suit to maintain status quo pending the hearing and determination of the motion on notice.

Subsequently on July 19, the court ordered the plaintiff to serve the originating summons on the defendants through substituted service.

The court also ordered all parties and defendants involved in the case to file their responses before the next adjourned date.

The matter was thereafter adjourned till September 22 for hearing.
