Justice Inyang Ekwo of the Federal High Court in Abuja has threatened to strike out a suit filed by the suspended Deputy Commissioner of Police, DCP Abba Kyari against the National Drug Law Enforcement Agency, NDLEA.

Kyari had filed a fundamental enforcement right suit against the Anti-Drug agency.

Justice Ekwo made the threat after the NDLEA counsel Joseph Sunday, complained that Kyari’s lawyer, Cynthia Ikenna, only served on him the “further and better” affidavit this morning.

The NDLEA counsel argued that by virtue of Order 2 of the Fundamental Enforcement Rights Civil Procedure Rules, 2019, the applicant was out of time to file the application.

Mrs. Ikenna prayed the court to give her more time as she had tried to meet with Mr Kyari in NDLEA’s detention at different times but was denied access.

Justice Ekwo ruled that if in the next adjourned date the lawyer isn’t prepared, he will strike the case out.

“Put your house in order before the next date of hearing, and if you do not, I will assume you are frustrating this matter, and the suit will be struck out,” he said.

The judge fixed April 7 for hearing of the matter.
