The Court of Appeal sitting in Enugu, the capital of Enugu State has sacked the member representing Aniocha/Dunukofia/Njikoka Federal constituencyof Anambra State, Hon Val Ayika of PDP and ordered INEC to issue certificate of return to the candidate of the APGA, Hon Dozie Nwankwo.
The candidate of APGA had appealed the ruling of the tribunal which upheld the election of the PDP’s candidate and ruled that Ayika was duly nominated by his party, PDP.
Delivering judgement on the appeal on the 1st of November, the appellate court ruled that the tribunal erred in ruling that Ayika was the candidate of the party stating that as at the time of the primaries of the PDP, Ayika wasn’t duly nominated.
The Appellate Court also directed the electoral umpire to withdraw the certificate of the PDP candidate and issue same to the candidate of APGA.
