Supreme Court

Nigeria’s apex court, the Supreme Court of Nigeria, has nullified the Peoples Democratic Party (PDP) national convention held in Ibadan, Oyo State, and dismissed the appeal filed by the Taminu Turaki-led faction of the party’s National Working Committee.

Delivering the majority judgment, Justice Stephen ruled that the convention, which took place on November 15 and 16 last year, was conducted in violation of an earlier judgment of the Federal High Court delivered by Justice James Omotosho.

The apex court strongly criticised the Turaki-led group for approaching another court of coordinate jurisdiction to obtain a fresh order rather than filing an appeal against the subsisting judgment, describing the action as a clear abuse of court process.

According to the court, “any litigant who engages in the act of abuse of court process does so at his or her own peril.”

Consequently, the court dismissed the appeal for lack of merit, effectively voiding the Ibadan convention.
